Article 1 — Who we are

These terms apply to all offers, agreements and deliveries via KSM Soundrecording, a trade name of KSM ICT, located at Valeriusstraat 25 in Veere, registered with the Dutch Chamber of Commerce (KvK) under number --------- and with VAT identification number ---------.

Article 2 — Applicability

These terms apply as soon as you place an order. Any deviating agreements only apply if we have confirmed them in writing.

Article 3 — Offers and prices

All prices on the website are in euros and include VAT, unless stated otherwise. Obvious mistakes and typing errors are not binding on us. Offers are valid for as long as they appear on the website.

Article 4 — Digital products

Our digital products are delivered as a download in your personal account. You'll get an account with your own library for this. Delivery is complete as soon as the product appears in your library, regardless of whether you download it immediately.

The number of downloads and the period during which you can download are stated with the product. If you run into a limit, let us know — we will reasonably reopen it for you.

Article 5 — License and use

You purchase the right to use the product yourself. You may not resell, republish, distribute it, or make it part of another product, unless we give written permission. All intellectual property rights remain with us or with the original rights holder.

Article 6 — Payment

Payment is made in advance using the payment methods on the website. We only grant access to the files after a successful payment.

Article 7 — No refunds after delivery

Digital products are immediately available once your order is complete. Because delivery is thereby complete, refunds after purchase are not possible. If a product doesn't work as described, see article 8 below.

Article 8 — Something not working?

If a product doesn't work as described, contact us within a reasonable time. We'll fix it: with a working version, a repair, or, if that's not possible, a refund. This is separate from your statutory rights regarding a defective product.

Article 9 — Liability

We carry out our work with care. Our liability is limited to the amount you paid for the order in question. We are not liable for consequential damages, lost profits or data loss, except in case of intent or gross negligence on our part. Always make your own backup of your game files and profile before installing a mod.

Article 10 — Complaints and disputes

If you have a complaint, please let us know first at info@ksm-soundrecording.com. We respond within fourteen days. If we can't resolve it together, you can turn to the European ODR platform at ec.europa.eu/consumers/odr. Dutch law applies to our agreements.
